TERMS & CONDITIONS – AESTHETIC WOLF

GENERAL

These terms and conditions apply to all purchase orders submitted to Aesthetic Wolf’s webshop on www.aestheticwolf.com (in the following referred to as the ”webshop”), this covering all purchase agreements that a consumer enters into from a distance with Aesthetic Wolf Apparel, hereinafter referred to as ”Aesthetic Wolf”). We encourage you to read these terms and conditions in their entirety before submitting an order. These terms and conditions may be updated and vary from time to time why we ask you to read the terms and conditions previous to every order you place in the webshop.

A binding purchase agreement is entered into as soon as your order has been confirmed by us and an order confirmation has been sent from Aesthetic Wolf to the e-mail address you submitted. If an item happens to run out of stock before the status has been correctly updated on the webshop, Aesthetic Wolf will notify you of this by e-mail. We may then suggest an alternative item, or cancel the order in question. If incorrect price information has been shown on the webshop you will be offered to either purchase the item to the correct price, or cancel the order. Aesthetic Wolf reserves the right to decline or rescind a purchase agreement if fraud or other actions similar to fraud, such as unlawful use of another person’s credit card, can be suspected.

To place an order in the webshop you must be at least 18 years old and not under guardianship. Aesthetic Wolf presumes that minors who carry out purchases on www.aestheticwolf.com submit truthful information of their age and/or possess the necessary consent from their custodian to purchase the item(s). If not, the buyer may become liable for the possible costs an invalid agreement may involve. 

PRICE & PAYMENT

The prices at the webshop are current prices and may be changed at any time. Aesthetic Wolf is not bound by price indications in the webshop which the buyer must reasonably or apparently understand are incorrect and which, for example, have occured due to technical problems in the web platform or rates that have been manipulated by the customer. Prices are inclusive of local VAT and are payable in the currencies indicated at the webshop. For non-EU customers, additional VAT, customs charges and other levies may be incurred by your local Customs Authority on your import, at applicable rates. Payment can be made by different methods, as shown on the website and on the checkout page. Where payment is subject to validation and/or authorisation by a card issuer or bank or to credit validation, any Order Confirmation is subject to such validation or authorisation. We co-operate with an authorized payment service provider (PSP), who processes your personal details in accordance with the international security standard PCI DSS, developed by international credit card companies such as VISA and MasterCard. All transactions will be sent through Extended SSL (Secure Sockets Layer) in encrypted form and all card details and payment information will be protected and processed with the highest level of security.

PROMOTIONS & DISCOUNT CODES

All campaigns with reduced price are limited in time. Multiple offers and codes cannot be combined, unless when granted specific written access. All discount and campaigns are only valid on ordinary prices. A discount code or voucher is only valid once per customer/purchase and not on any sale items, unless when granted specific written access. In case of obvious misuse of offers, such as coupons and promotion codes, the webshop reserves the right to cancel the order in question.

On orders eligible for a gift or discount the value of the gift/discount is considered as a general discount on the total amount of the order. If part of or the entire order is sent back for exchange or refund the value of the returned merchandise is recalculated and the purchase price minus the relative share of the overall discount will only be credited.

Promotions and discount codes are only valid on new orders and cannot be applied retrospectively.

DELIVERY

We always aim at delivering your order as soon as possible. Normally orders of items in stock are processed and shipped within 1-3 business days from Order Confirmation and can be expected to be delivered in 1-4 business days within Belgium and 2-15 business days on International orders. Delivery times are estimates only and particularly during high season (e.g. Christmas, Black Friday and other sales/campaigns) deliveries may take longer than normal. In case of a delay in delivery of more than fifteen (15) business days beyond the estimated delivery time above, you may cancel your order subject to written notice to us, in which case we will, as our entire liability for the delay, credit any payment made by you. If the order has already shipped, you must first return the item to us before such credit can be made. The freight cost will be specified in the order summary before you submit your order. We currently ship to most countries but may not ship to certain countries. Should you have an inquiry as to whether or not we ship to a specific location, please contact our Customer Service. Please be advised that custom duty may be charged for any orders from outside the European Union. You are asked to inspect delivered items upon delivery and report any deviations found as stated under Returns below. In case you fail to collect your products upon delivery, we reserve the right to debit you a charge to cover our cost for return freight and administration.

RIGHT OF WITHDRAWAL AND RETURNS

We offer you a specific right-of-return from your purchase. If you wish to make such a return please follow our return policy. Items shall be returned hereunder properly wrapped and packed in their original packaging in unused and saleable condition. As soon as we have received the returned items, and have been able to confirm that the requirements above are met, we will refund your payment. In case you find that an item delivered by us to you is defective you should contact Customer Service as soon as possible, to get a replacement delivery or, if that is not possible, a refund. The same applies in case you identify that a product has been damaged during transportation or you identify other deviations in the delivery, e.g. that the number of items or the product model delivered is not in line with your order. Returns here under shall be sent to Customer Service or to the other address specifically instructed by us. In case of a return the risk (for loss or damage during delivery) is on the customer. Please read the return policy carefully, since returns and exchanges out of Europe may be costly for the customer.

The right of withdrawal and returns only applies to consumers. We offer services to resellers / partners, whom are eligible to other advantages, specifically applying to B2B partnerships. However, Aesthetic Wolf never accepts returns and refunds in any form or way after the professional purchase of products. It is commonly accepted that the professional buyer does his due diligence before any purchase and is responsible for his bought product after.

DAMAGED PRODUCTS

Aesthetic Wolf ensures that all products are meticulously checked in a quality control before being dispatched to our customers. We work hard to avoid the emergence of damages or defects in our products. Should you find that an item despite this is damaged or otherwise defective, you will be replaced with a new sample of the item in question, if a new one is available. If not, you will be refunded with the original cost of the item and the return cost, unless the defect can be repaired. If the damaged item followed an order containing other purchased items the cost of the original delivery will not be repaid. You are asked to always examine your received products already at the time of delivery and as soon as possible report any deviations from your order confirmation to us.

We will return your funds as soon as possible, at the latest within 15 days from the date you returned the item and it was received by Aesthetic Wolf , and we have established that the item is damaged or otherwise defective. Always save your receipt. The funds will be returned to your original method of payment. If you paid using your credit card, the amount will be repaid to the same card.

COLOURS

We cannot guarantee that the colours appearing on the online store in detail reflect the product colours. The colours can be reflected in different ways depending on for example your computer or phone screen, graphic card and the computer settings.

B2B PARTNER QUOTATIONS, INVOICES AND PAYMENTS

Orders placed in the name of the Customer shall be deemed to have been placed by the Customer and shall be binding. Aesthetic Wolf has the right to attach conditions to the execution of an order and/or assignment, such as for example asking for a deposit or advance payment, or other security, and can refuse an order of the Client without giving reasons.

Each agreement is entered into under the suspensive condition of sufficient availability of the services and products concerned. The agreement is established by Aesthetic Wolf’s confirmation of the Client’s order, or by Aesthetic Wolf’s commencement of the execution of the order. Confirmation can take place electronically (for example via the website, by email or via a digital link) or, in writing (by letter or email) or verbally. The order confirmation is deemed to accurately and completely reflect the agreement, unless the Client objects to it in writing or electronically within 2 working days of receiving the order confirmation. If not indicated otherwise, made quotations are valid for 30 days. 

The cancellation of accepted quotations is no longer possible if the material was put into production as a result of the order, or if the purchase has already been processed. If the order has not yet been processed, it can be cancelled after written or electronic confirmation of Aesthetic Wolf for a processing fee of 10% of the quotation amount. This does not affect Aesthetic Wolf’s right to claim damages suffered (e.g. lost profit).

The price stated in the agreement is binding, unless between the time of ordering and the time of delivery there are circumstances that increase the cost price of the goods ordered. In that case, Aesthetic Wolf is entitled to increase the prices accordingly. Such a price increase shall entitle the Customer to dissolve the contract.
Unless expressly agreed otherwise in writing, payment shall be made without settlement or suspension on any account whatsoever. The Client agrees to reimburse Aesthetic Wolf for any costs incurred in investigating and dealing with any incident mentioned in these Terms and Conditions. All payments made by the Client shall first serve to pay any interest and/or (collection) costs due and subsequently to pay the oldest outstanding invoices.
The Client is requested to fill in the invoice number when paying. All invoices are, unless stated otherwise on the invoice, only payable by transfer or deposit into the account number of Aesthetic Wolf. The Client shall transfer the total invoice amount for the goods and/or services delivered to Aesthetic Wolf to the account number listed on the invoice or quote within a period of 30 days.
Invoices are sent to the Customer electronically, unless he makes a written request to receive them by mail. In this case Aesthetic Wolf is entitled to charge an additional cost of €4,95 per invoice sent by post. In case of non-payment of the invoice by the twice past due date without serious reason, the balance shall be increased – without the need for a formal notice – by a fixed penalty of 15% on the total outstanding invoice amount with a minimum of €25 and a maximum of €1,500, even if terms of grace are granted. All assignments formally confirmed or contractually stipulated by the Client are irrevocable, regardless of whether or not an advance payment has been made. Where appropriate, the advance payment made by the Principal shall be deducted from the total price of the assignment.

Lastly, the B2B Partner or Reseller is strictly allowed to resell the Aesthetic Wolf products on his/her own webshop or in his/her own physical store. The resell on third party platforms such as, but not limited to, Bol.com;Amazon.com;Zalando.com; is strictly forbidden.

INTELLECTUAL PROPERTY RIGHTS

Aesthetic Wolf owns all intellectual property rights in the website and in the material published on it. These works are protected by copyright laws worldwide.

Permission is granted to temporarily download one copy of the materials (information or software) on Aesthetic Wolf’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials, use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

attempt to decompile or reverse engineer any software contained on Aesthetic Wolf’s web site; remove any copyright or other proprietary notations from the materials; or

transfer the materials to another person or “mirror” the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Aesthetic Wolf at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
